DENTAL HIPAA: NEW HITECH LAW

Have you heard of the new  HI TECH LAW?  If you are a dental office, you will!  Effective February 20, 2010 you will be required to have new
written laws in place that govern the way you handle Private Health Information(PHI), especially when using computers.  If it sounds like a lot of work, it is… But read on for the simplest solutions to getting this bugger in place!...

What’s it all about?...

The healthcare industry is in the midst of a sweeping change.  Internet information sharing has made Private Health Information (PHI) vulnerable to many indiscretions.  From disgruntled employees stealing patient info and maliciously posting it on the internet, to hackers stealing insurance ID information and misusing social security numbers, the breaches are serious and astounding.   The federal government has established immediate protective action for the way health records are managed. The Health Information Technology for Economic and Clinical Health Act (HITECH or “The Act”), of 2009 (ARRA), encourage the use of health information technology by endorsing several incentives.  Electronic health records (EHR) systems among health care providers has increased but, this diminishes privacy and security regulations under (HIPAA). 

Now this electronic health information sharing will be subject to much stricter guidelines.  Penalties for HIPAA violations range from $100 to $50,000 per incident for businesses in non-compliance. And civil penalties (placed upon employee breaches) will be strict and hefty as well.  Yes employers as well as employees have to be very aware and careful with PHI!

How can you get your Risk Management / HI TECH Law requirements in place properly and effectively? Does anyone like doing OSHA in Dental Offices?

I do!  No really I do!  I’ve been a coach for Dental OSHA and Dental HIPAA for several years now and it always amazes me how so many dental offices have had terrible such training in the past.  OK, I’ll admit its boring complicated and seems that so much crazy paper works needs to be done to support proper OSHA compliance.  But if you hook-up with the right support….your Dental OSHA Training and Dental HIPAA Training will be a breeze!

Dental Office OSHA Employee Annual Training / Requirements

Every state requires OSHA Employee Training within the dental office setting.    Each year dental teams are required to partake in a current OSHA / HIPAA Annual Employee Training to ensure their team measures up to what the law dictates.  Finding the best training course can make you crazy!  There are training DVDs, workbooks, trainers that come to you.  It takes valuable time away from patient care and usually an hour or two of boring laws about MSDS Sheets, OSHA Manuals, Bio Hazard Labels, Hazard Communication Plans, Exposure Control Plans, Bio Medical Waste Plans, Sterilization Practices and Safety Laws that cross-over into the mega boring and sublime!

If you live and practice in these states, you only need to follow Federal OSHA Standards.

If you however, live in these states you’ll have additional State OSHA Laws to abide by:  Alaska, Arizona, California, Connecticut, Hawaii, Indiana, Iowa, Kentucky, Maryland, Michigan, Minnesota, Nevada, New Mexico, North Carolina, Oregon, Puerto Rico, South Carolina, Tennessee, Utah, Vermont, Virgin Islands, Virginia, Washington or Wyoming. 

Keep in mind that Illinois, New Jersey and New York have State OSHA laws for State employees only.
